Disney PhotoPass Terms & Conditions at Disneyland Resort

The Disney PhotoPass service is operated by Disney Photo Imaging, LLC ("Disney," "we," "us," or "our"). These Terms and Conditions apply in addition to, and not in lieu of, The Walt Disney Company Terms of Use found here: http://disneytermsofuse.com/. In the event these Terms and Conditions directly conflict with the applicable foregoing Terms of Use, these Terms and Conditions will prevail.
Disney PhotoPass Service and Products at Disneyland Resort
Copyright Policy, Restrictions on use of Materials
- All photos and other digital content captured by the Disney PhotoPass service (collectively, “Photo Content”) are owned and copyright protected by Disney. Please be aware that it is illegal to reproduce or distribute copyrighted material without the permission of the copyright owner. Photo Content, including prints and other products produced with any Photo Content, may not be reproduced without permission from Disney. Accessing pictures or text provided on web sites does not give you any rights to use them. Only the copyright owner, or the owner's legal agent, can grant permission to copy, distribute, or publicly display protected material.
- Guests who purchase any Photo Content from Disney, or download or otherwise access any Photo Content with the permission of Disney, will receive, and such Photo Content is subject to, a limited license for personal, non-commercial use of the downloaded Photo Content, as available.
Storage Policy and Photo Content Availability
- Photo Content linked to a Disney account is usually available online within 24 hours after the Photo Content was taken. Guests must claim Photo Content before it expires. Except as otherwise indicated in these Terms and Conditions, Photo Content (including as applicable, such content captured during a Disney PhotoPass+ Window [defined below], a Disney Genie+ Window [defined below], or a Magic Key Benefit Window [defined below]), as available, will expire pursuant to the Expiration Policy. We do not offer options for permanent storing of any Photo Content. Expired Photo Content will no longer be available for Guests to access.
- Disney reserves the right to remove or refuse to post or upload any Photo Content in our sole discretion, including any Photo Content that contains content of poor quality or that might be deemed to be inappropriate or offensive.
- We are not responsible for missing, lost or damaged Photo Content.
- Certain Photo Content may be provided, at your election, to select, Disney-approved third-party companies in connection with products and services offered by those third-party companies (collectively, “Third-Party Products”). Not all Photo Content is available for use in Third-Party Products, and Disney reserves the right to refuse to provide any Photo Content to any third-party companies in our sole discretion. Once certain Photo Content is provided to a third-party company, such Photo Content will be subject to the availability, storage, expiration, privacy and other policies and terms governing that third-party company’s products, services and site or platform. Neither Disney nor any of its affiliates shall be responsible or liable for such third-party company’s products, services, site/platform or actions.
Availability and Delivery
- With respect to products offered directly by Disney (collectively, “Disney PhotoPass Products”), receipt of your order does not guarantee that we can supply the selected products to you. All Disney PhotoPass Products are subject to availability and we must therefore reserve the right: to limit quantities of products we supply; to supply only part of an order or to divide up orders; and to alter the availability and duration of, and to terminate at any time, any special offers. We will not charge your credit card unless, or to the extent, we are able to deliver the Disney PhotoPass Products to you as ordered.
- We will use all reasonable means to ensure your purchases of Disney PhotoPass Products are delivered promptly but we cannot guarantee that there will be no delays in delivery, and accept no liability or responsibility for delayed delivery of products.
- Availability and delivery of Third-Party Products will be subject to the policies governing that third-party company’s products and services.
Prices and Payment
- Please note that the prices of Disney PhotoPass Products offered on the Disneyland site and app do not include sales tax, if any, and shipping costs which vary depending on delivery option and location. Prices are subject to change at any time prior to acceptance of your order and in case of a change we shall notify you and ask whether you still wish to proceed. Payment for Disney PhotoPass Products shall be made by credit card.
- International Customs Policy: Prices for Disney PhotoPass Products do not include duties or value-added taxes. If assessed, these charges are the responsibility of the package recipient, who will be billed for them by the local Customs office. Please keep this in mind if you are shipping your order to a recipient outside the U.S.
- Prices and payment for Third-Party Products will be subject to the policies governing that third-party company’s products and services.
Return Policy
- Purchases of Photo Content may not be canceled and any purchase fee is non-refundable.
- Disney PhotoPass Collection products are non-refundable.
- If you are not satisfied with the quality of any physical Disney PhotoPass Product you purchase, you may return it within 14 days of purchase and we will either reprint the product at no cost to you or refund the original purchase price.
- Returns and refunds for Third-Party Products will be subject to the policies governing that third-party company’s products and services.
Additional Terms
- The Disneyland PhotoPass Product Code for Disney PhotoPass Collections and Disney PhotoPass+ products may only be used once. Make sure you have linked all your photos from your visit and you are ready to activate the Disney PhotoPass Collection product prior to entering the code. Photos and other digital content added to your account after you have used the Product Code are not included in Disney PhotoPass Collections but can be purchased separately.
- Photos and other digital content captured as part of Premium Photo Sessions and other family portrait sessions or by Disney Event Group (including, but not limited to, Disney Fairy Tale Weddings photos and group and convention photos) or by third party operators at the Disneyland Resort, are not included in Disney PhotoPass+ products or Disney Genie+ service, the Disney PhotoPass Magic Key benefit, or Disney PhotoPass Collections.
- Photo Content, Disney PhotoPass service, Disney PhotoPass+ products and Disney Genie+ service, the Disney PhotoPass Magic Key benefit, and Disney PhotoPass Collections are intended for your personal use only. Downloading or unlocking, or offering to download or unlock, Photo Content for the benefit of other guests, whether or not you solicit or accept any consideration or remuneration for such Photo Content, is a violation of these Terms and Conditions and the limited license granted to you. Violations may result in removal of all images associated with your account and termination of your Disney account. We reserve the right in our sole discretion, including based on usage patterns, to conclude that you are in violation of these Terms and Conditions.
- Purchased and complimentary Disney PhotoPass services, products and Photo Content are nonrefundable, may not be redeemed for cash, and may not be used as credit towards the purchase of any other service or product.
- Online registration is required.
- These Terms and Conditions are subject to change without notice.
Disney PhotoPass+ Products, Disney Genie+ Service and Magic Key Benefit at Disneyland Resort
- Disney PhotoPass+ products and Disney Genie+ service, and the Magic Key benefit, are non-refundable, non-transferrable and may not be redeemed for cash.
- With the Magic Key benefit or the purchase of a Disney PhotoPass+ product or Disney Genie+ service, you will be able to download all Photo Content associated with your Disney account that were taken at the Disneyland Resort by Disney PhotoPass photographers, as well as Photo Content taken on select attractions and at select dining locations at the Disneyland Resort during the validity dates of your eligible Magic Key pass (the “Magic Key Benefit Window”), while your Disney PhotoPass+ product is active (the “Disney PhotoPass+ Window”) or during the day(s) that your Disney Genie+ feature is active (the “Disney Genie+ Window”), respectively. You will also receive a limited license for personal, non-commercial use of the downloaded Photo Content, as available.
- If you have purchased Disney PhotoPass+ One Week, the Disney PhotoPass+ Window begins at 6:00 a.m. Pacific Time on the date of the Photo Content selected on Disneyland.com/photopass when purchasing Disney PhotoPass+ One Week (or when activating Disney PhotoPass+ One Week purchased in advance), and ends on the 6th day after such date at 11:59 p.m. Pacific Time (which, including the day of activation, creates a Disney PhotoPass+ Window of seven (7) days).
- If you have purchased Disney PhotoPass+ One Day, the Disney PhotoPass+ Window begins at 6:00 a.m. Pacific Time on the date of the Photo Content selected on the Disneyland app or on Disneyland.com/photopass when purchasing Disney PhotoPass+ One Day (or when activating Disney PhotoPass+ One Day purchased in advance) and ends at 5:59 a.m. Pacific Time on the following day.
- If you have purchased the Disney Genie+ service, for each day of the Disney Genie+ Window, you will be able to download Disney PhotoPass Photo Content associated with your Disney account captured at the Disneyland Resort beginning at 6:00 a.m. Pacific Time on the day you purchase Disney Genie+ service if purchased after park entry, or on the day of theme park ticket use if purchased as part of a theme park ticket, and ending at 5:59 a.m. Pacific Time on the following day.
- If you have an eligible Magic Key Pass as designated by Disney from time to time, you will be able to download Disney PhotoPass Photo Content associated with your Disney account captured at the Disneyland Resort while such Pass is valid for admission to a Disneyland Theme Park.
- Unless otherwise stated herein or otherwise provided as part of another Disney PhotoPass benefit, all Photo Content captured outside of your Disney PhotoPass+ Window, Disney Genie+ Window, or Magic Key Benefit Window must be purchased separately. Certain digital content may not be available for purchase on an individual item basis.
- Disney PhotoPass+ products and Disney Genie+ service may be linked to only one (1) guest. Only the person who has a Disney PhotoPass+ product or Disney Genie+ service linked to their Disney account can download the Photo Content captured during the Disney PhotoPass+ or Disney Genie+ Window.
Disney PhotoPass Lenses at Disneyland Resort
In addition to the general Terms and Conditions above, the following terms are applicable if you have purchased (including as part of the Disney Genie+ service) or are otherwise accessing and using the Disney PhotoPass Lenses product at Disneyland Resort.
- An eligible mobile device with the Disneyland app is required to access and use Disney PhotoPass Lenses. To access and use Disney PhotoPass Lenses, you must grant the app access to your mobile device’s camera and location. Granting the app access to your device microphone is optional; however, if you do not grant this access, then your videos will record without sound. Granting the app access to your photo library is also optional; however, if you do not grant this access, then you will not be able to store photos and videos captured using Disney PhotoPass Lenses to your mobile device. The Disneyland app will process and, if applicable, store, photos and videos captured using Disney PhotoPass Lenses on your mobile device. They will not be saved to your Disney Account.
- Select Disney PhotoPass Lenses in the Disneyland app may be accessed and used only at Disneyland Resort or within designated locations at Disneyland Resort (collectively, “Location-Specific Lenses”). Each Location-Specific Lens in the Disneyland app will identify the specific location in which that lens is exclusively available.
- Your use of Disney PhotoPass Lens photos or videos is subject to a limited license for personal, non-commercial use, and neither Disney nor our service providers in connection with Disney PhotoPass Lenses (including, without limitation, Snap Inc.) confer any rights of ownership to you. Otherwise, your access and use of Disney PhotoPass Lenses will be treated as User Generated Content under our Terms of Use.
- Note that the standard Disney PhotoPass expiration policy does not apply to your Disney PhotoPass Lens photos and videos. Disney PhotoPass Lenses are not included as part of Disney PhotoPass+ products.
- Important Notice about Attribute Lenses. Some Disney PhotoPass Lenses available in the Disneyland app use technology that detects the coordinates of key points on your face and/or hands (“Attribute Lenses”) in order to allow you to apply such lenses to your photos and videos. When using Attribute Lenses, your face and hand data will be processed on the device on which you are using the Disneyland app and will not be stored or retained. Attribute Lenses may be used only for your personal and independent use and no other individuals may appear in photos and videos captured using Attribute Lenses. If you nonetheless allow another individual to appear in a photo or video you capture using Attribute Lenses, you must read the disclosure in the Disneyland app to them and obtain their consent to use Attribute Lenses on their image, and you assume all responsibility for the use of Attribute Lenses on the photo or video of that individual. Attribute Lenses are not available for use outside of the 50 United States and District of Columbia or in Illinois; Portland, Oregon; or Texas. Attribute Lenses may be used only by Guests ages 18 and older. Using and accessing Attribute Lenses require your acknowledgment of and consent to these and other important terms, which will be obtained prior to your initial access and use. If you are unable to provide the foregoing consent, you will not be permitted to use Attribute Lenses, although other Disney PhotoPass Lenses in the Disneyland app will be available in accordance with these terms.
- Disney PhotoPass Lenses as part of the Disney Genie+ Service. If you receive access to Disney PhotoPass Lenses as part of your purchase of Disney Genie+ service, your ability to access and use Disney PhotoPass Lenses begins at the time you enter a Disneyland theme park using admission media with an associated Disney Genie+ benefit and, except for Location Specific Lenses as provided above, ends at 5:59 a.m. Eastern Time on the date that is 45 days following such date. When purchased as part of the Disney Genie+ service, your access to and use of Disney PhotoPass Lenses are subject to the cancellation, refund and transferability policies of the Disney Genie+ service.
- Disney PhotoPass Lenses not part of the Disney Genie+ Service. If you access and use any Disney PhotoPass Lens other than as part of a Disney Genie+ service purchase (as set forth above), the period during which you may access and use such Disney PhotoPass Lens will be provided in the information drawer accompanying that lens in the Disneyland app; and, if the lens is a Location-Specific Lens, your access and use of such lens will also be limited to the specific location identified in the Disneyland app.

Disney PhotoPass+ Aulani
- Disney PhotoPass+ Aulani is non-refundable, non-transferrable and may not be redeemed for cash.
- With the purchase of Disney PhotoPass+ Aulani, you will be able to download all Disney PhotoPass photos and other digital content associated with your Disney account that were taken at Aulani Resort by Disney PhotoPass photographers while your Disney PhotoPass+ Aulani is active (the “Disney PhotoPass+ Aulani Window”). You will also receive a limited license for personal, non-commercial use of the downloaded photos and other digital content, as available. Disney PhotoPass+ Aulani Window begins at 6:00 a.m. Pacific Time on the date of your Disney PhotoPass+ Aulani purchase, and ends on the 29th day after such date at 11:59 p.m. Pacific Time. Your Disney PhotoPass+ Aulani purchase also includes all unexpired photos and other digital content that were taken at Aulani Resort within the 29 days prior to the date of your Disney PhotoPass+ Aulani purchase.
- Disney PhotoPass+ Aulani includes photos and other digital content taken at Aulani Resort by Disney PhotoPass photographers, at Disney character experiences, during underwater photography experiences, and on the Photo Scavenger Hunt. Disney PhotoPass+ Aulani excludes photos and other digital content captured photos and other digital content captured by Disney Event Group (including, but not limited to, Disney Fairy Tale Weddings photos and group and convention photos) or by third party operators at Aulani Resort.
- Unless otherwise stated herein, all photos or other digital content captured outside of your Disney PhotoPass+ Aulani Window must be purchased separately. Certain digital content may not be available for purchase on an individual item basis.

Expiration Policy (Aulani Resort)
- Disney PhotoPass photos, dining photos and attraction photos in your account will expire 45 days from the date the photo was taken. If you would like to extend the expiration date to 60 days from the date the photo was taken, you may purchase an Expiration Extension. All photos in your account as of the day the Expiration Extension is purchased will now expire 60 days from the date the photo was taken (instead of 45 days).
- Expiration dates of photos may only be extended once.
- Disney does not offer options for permanent storing of photos or other digital content. Expired photos and other digital content will no longer be available.
- To view the expiration date of a photo, select the photo from the Media Gallery to preview the enlarged photo. The date the photo was taken and the expiration date of the photo will display beneath the enlarged photo.
- Please note that the individual expiration date for each photo may vary. Disney reserves the right to not upload photos which are deemed to be of poor quality and/or contain content that might be deemed to be offensive. Subject to restrictions and change without notice.
Expiration Extension
- If you need more time, you may purchase a one-time 15-day extension for the Disney PhotoPass photos, dining photos and attraction photos and videos in your account. To purchase an Expiration Extension, access the Additional Products page and select the Expiration Extension product. Upon completion of your purchase, your expiration date will be set to 60 days from your original taken or capture date of the photo. Your new expiration date will display on your photos when you view them one-by-one.
- Please note the individual expiration date for each photo may vary.
Additional Terms
- To view the expiration date of a photo, select the photo from the Media Gallery to preview the enlarged photo. The date the photo was taken and the expiration date of the photo will display beneath the enlarged photo.
